Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Ballpark Reptiles LLC ("we," "us," or "our"), which operates My Reptile Atlas (the "Service"), a web application for tracking reptile and animal collections, breeding, genetics, and sales. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. You are responsible for the information you provide, for keeping your password secure, and for all activity that happens under your account. Notify us promptly at ballparkreptiles@gmail.com if you believe your account has been compromised.
2. The Service & subscriptions
We offer a free tier and a paid subscription ("Plus") with additional features, along with an initial free trial. Paid subscriptions are billed through our payment processor, Stripe, on a recurring basis until cancelled.
- You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period.
- Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial periods.
- Prices, plans, and feature limits may change; we will give reasonable notice of material changes to paid plans.
- Promotional, referral, and discount codes are subject to their stated terms and may be changed or withdrawn.
3. Your content and data
You retain ownership of the information you enter into the Service, including your animal records, photos, breeding and sales data, and notes ("Your Content"). You grant us a limited license to store, process, back up, and display Your Content solely to operate and provide the Service to you. You are responsible for ensuring you have the right to upload Your Content and that it does not violate any law or third-party rights.
4. Our intellectual property
The Service itself — including its software, source code, design, layout, features, text, graphics, logos, the My Reptile Atlas name, and the Ballpark Reptiles LLC brand — is owned by us and protected by intellectual property laws. These Terms do not transfer any of our intellectual property to you. We grant you only a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.
5. Acceptable use & restrictions
You agree that you will not, and will not permit anyone else to:
- Copy, reproduce, modify, translate, or create derivative works of the Service or any part of it;
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying structure of the Service, except to the limited extent this restriction is prohibited by law;
- Scrape, crawl, harvest, or use automated means or bots to access, extract, or copy data from the Service;
- Resell, sublicense, rent, lease, or otherwise commercially exploit the Service, or use it to build or assist a competing product or service;
- Circumvent, disable, or interfere with security, access controls, plan limits, or rate limits;
- Use the Service to store or transmit unlawful, infringing, or malicious content, or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to any account, system, or data that is not yours.
We may investigate and take appropriate action, including suspending or terminating accounts, for any violation.
6. Genetics calculator & informational features
Features such as the genetics calculator provide estimates and possibilities for planning purposes only. Genetic outcomes, offspring appearance, health, and value are not guaranteed and depend on factors outside our control. You are solely responsible for decisions you make about your animals, breeding, and sales. The Service is a record-keeping and planning tool and is not veterinary, legal, financial, or professional advice.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — will survive.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. You are responsible for keeping your own copies of important data.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or animals, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty U.S. dollars (US$50).
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be subject to the exclusive jurisdiction of the courts located there, unless otherwise required by applicable law.
